New Board of Directors

The Annual Homeowners Meeting was held on January 22, 2004 at the Carpenter Recreation Center. One of the items on the agenda was the election of the Board of Directors. The following homeowners were elected to the Board:

Annual Meeting Minutes

The Annual Homeowners Meeting was held on January 22, 2004 at the Carpenter Recreation Center.

There were 11 out of 278 homeowners in attendance plus the 3 board members. The meeting started with a review of 2003. The board was focused on finding a new management company to replace Principle Management. The new company is Neighborhood Management Inc (NMI) and will take over creek trails April 1, 2004. There was also a significant amount of time reviewing the screening walls with the City of Plano. Currently, the HOA owns the walls and must repair them, particularly a section along Rainier. This will be addressed in the spring, once 2004 dues are received.

The HOA also had an issue with someone re-programming the sprinklers specifically the control box behind Norway Ct. If you see or know anyone who has done this, please notify Barb Yass immediately. This cost the HOA an extra $2,000 in water bills in 2003. Fallas Landscaping has re-locked the control boxes again.

We reviewed the financials for 2003 and looked at the budget for 2004. Then the board elections were held. This was followed by open discussion. It was suggested that an independent audit be done at the end of each Board of Directors to review the HOA financials. It was also suggested that the next meeting be held at Oak Point instead of Carpenter.

Foreclosures have begun

Due to the large number of homeowners who owe over 2 years of association fees, the board has given Principle Management and Riddle and Williams (the HOA attorneys) permission to proceed with foreclosing on these houses.

Keep Plano Beautiful

April 3, 2004 has been designated as Keep Plano Beautiful day. The HOA would like to clean up the neighborhood, primarily the creek area on this day but we NEED your help. The HOA will provide refreshments. We plan on cleaning up the common areas and the perimeter of the neighborhood from 9am - 11am. Please meet at the Pecan Tree (off Palmetto) at 9am. Bring your tree trimming tools, we will provide trash bags. If you are planning on helping, please call Barb Yass at 972-517-5533 so we have enough refreshments for everyone.

HOA Dues

There are a number of homes that haven't paid their annual dues yet for this year. Here is what happens when you don't pay your dues.

Late/Collection fees were assessed after March 15, 2003. If payment was not received by this date a 30-day demand letter is sent.

After 30 days if the Homeowner did not pay, a letter of intent to file with the credit bureau is sent giving the Homeowner 10 days to pay.

If they have not paid within 10 days, they are reported to the credit bureau and a letter is sent to the Homeowner notifying them of this.

If not paid within 10 days a title search is ordered.

If payment is not received when the title search comes back from the title company, a certified letter is sent to the Homeowner informing them of the title search & if not paid in another 10 days a lien is placed on the property and a letter is sent to the Homeowner informing them of this.

If the Homeowner does not pay after getting the lien notification letter the file is sent to the attorney to send out a demand letter.

After the above, the HOA has the right to foreclose on your home. Due to the increase of homes that haven't paid their dues, the HOA is looking into going forward with foreclosures.

Deed Restrictions

Homeowner and residents of the CREEK TRAILS subdivision have specific responsibilities and restrictions regarding the exterior appearance of their homes. These are documented in the "Declaration of Covenants, conditions, and Restrictions" which is the legal document filed in the Collin County Courthouse and applies to every lot and house within the CREEK TRAILS subdivision. Below is a list of items that are often forgotten.

Trash Can / Recycle Bin must be stored 'out of sight' from the street.

Boats / Trailers / Mobile Homes/ Large Trucks are prohibited from the neighborhood. This includes in your driveway or on the street.

Fences must be maintained. You are not required to have a fence, but if you do have one, it must be in good condition.

Yards (including lawns, trees, and shrubs) must be maintained.

Violation of any deed restriction may result in a fine. See Deed Restriction Enforcement Policy for details.

HOA Picnic

The HOA picnic is April 24, this year (provided we get volunteers to help). We are looking for volunteers to help with planning the festivities. Please call Reginald Edwards at 972-527-7472 if you are interested in helping with the picnic.
